The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: “Client”, “You” and “Your” refers to you, the person log on this website and compliant to the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of Netherlands. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same. Terms and Conditions for Activ8 Posture Memberships and Session Packages

Cancellation Policy

We understand that life happens. Please provide at least 24 hours’ notice if you need to cancel or reschedule any session. Cancellations with less than 24 hours’ notice or missed appointments (no-shows) may result in:  

• • For Monthly Memberships: Deduction of the missed session from your monthly balance.  

• • For Session Packages: Deduction of the missed session from the prepaid session package.  

We value your time and ours—help us provide the best service to all clients by keeping us informed about your schedule changes in advance.

Agreement for Membership and Session Package Services

This Agreement (the “Agreement”) governs the terms and conditions of both monthly memberships and prepaid session packages offered by Activ8 Posture. By purchasing either option, the client agrees to all terms outlined in this Agreement.

Definitions

• • Monthly: Refers to a 28-day cycle, equivalent to a 4-week billing period.

• • Session Packages: Prepaid bundles of individual therapy sessions purchased at a discounted rate.

Services Provided  

Membership Services  

1.1. Membership Plans: Activ8 Posture provides recurring posture therapy sessions as part of a membership package. The number of sessions per month depends on the selected membership level, as outlined in Appendix A.  

1.2. Gifting Sessions: Membership sessions may be gifted to another person, with 2 days’ prior written notice.

1.3. Membership Pause: Clients may pause their membership for up to 3 months, with written notice provided before the next billing date. No fees will be charged, and sessions will not accrue during the pause period.

Session Packages

1.4. Expiration: All prepaid session packages must be used within 1 year of purchase. Unused sessions will expire after this period.

1.5. Refunds on Packages: If the package is not fully used, a prorated refund will be available based on the individual session rate at the time of purchase. However, refunds will not be issued beyond 6 months from the purchase date.

Payment Terms  

Membership Payments

2.1. Membership fees are billed every 28 days (on a 4-week cycle), with a total of 13 payments per year.

2.2. Payments are automatically debited via ACH or credit card on either the first or fifteenth of each cycle.

2.3. No enrollment fees are charged—fees cover services only.

Session Package Payments

2.4. Session packages must be prepaid in full.  

Session Rollover and Expiration  

For Memberships  

3.1. Sessions must be used within the 28-day billing period.  

3.2. Unused sessions will roll over to the next billing period, but any unused sessions after the second cycle will be forfeited.

3.3. Sessions can be gifted to another individual before they expire.

Term and Renewal for Memberships

4.1. Memberships are for a 1-year (52-week) term, automatically renewing for successive 1-year terms unless canceled.  

4.2. Written notice of cancellation is required prior to the renewal date to prevent automatic renewal.

Cancellation and Termination

Cancellation by Client

For Memberships

5.1. Memberships can be canceled with 30 days’ written notice.

5.2. Any payment due within the 30-day notice period will still be charged, but no further payments will be collected beyond that point.

For Session Packages

5.3. Session packages may be discontinued by the client at any time.

5.4. Refunds are issued according to the Refund Policy below.

Termination by Company  

6.1. Activ8 Posture may terminate this Agreement by providing 30 days’ written notice to the client.

Rescheduling and Company-Initiated Cancellations  

11.1. If Activ8 Posture needs to cancel or reschedule a session due to unforeseen circumstances, we will notify you as early as possible.  

11.2. In cases where rescheduling conflicts with the session expiration policies, exceptions may be made at the discretion of Activ8 Posture. We will work with you to find a suitable time for the rescheduled session.

Minor’s Provision  

If the client is under 18 years old, this Agreement must be signed by a parent or legal guardian, who:

• • Confirms they have read and understood the terms of this Agreement;  

• • Agrees to the terms on the minor’s behalf and ensures the minor complies with them;  

• • Takes responsibility for the minor’s actions while receiving services from Activ8 Posture.  

By signing, the parent or guardian indemnifies Activ8 Posture from claims or liabilities arising from the minor’s participation.  

Refund Policies  

Refunds on Memberships  

• • Membership fees are non-refundable.

• • Any unused sessions must be used or gifted before expiration.

• • To discontinue monthly membership payments

Refunds on Session Packages  

• • If you request a refund, it will be prorated based on the price of individual sessions at the time you purchased the package (i.e., the discounted rate will no longer apply).

• • Refund requests must be made within 6 months from the original purchase date.

• • All session packages must be used within 1 year of purchase. After this 1-year period, any unused sessions will expire, and no refunds will be issued for expired sessions.

Liability Waiver

As part of this Agreement, clients must sign a Liability Waiver, which is incorporated herein by reference. This waiver releases Activ8 Posture from liability for injuries or other damages that may occur during the use of our services.

Governing Law  

This Agreement shall be governed by and construed in accordance with the laws of Massachusetts (or California if working through these locations).

Entire Agreement  

This Agreement, along with Appendix A and the Liability Waiver, constitutes the entire understanding between the client and Activ8 Posture.

Appendix A: Membership Levels and Pricing  

Individual sessions for existing clients (who have completed the new client IMPACT program) are also available at $225 per session.
